Terms of Service and Waiver of Liability Agreement

This is an Agreement between you “ Astroville Tours LLC client” and our company “Astroville Tours LLC.”  Our website Astrovilletours.com is designed to help you discover more about Downtown Houston and our specialized Downtown Houston Tours for people of all ages & interests. 

 

Please note, Astroville Tours LLC reserves the right to present this website and provide any tours services offered conditionally based on your acceptance without modification to the terms, conditions, and notices contained herein (the "Terms of Service and Waiver of Liability Agreement"). Your use of Astrovilletours.com and any Astroville Tours LLC tour service provided by Astroville Tours LLC constitutes your legal consent and agreement to the Terms of Service and Waiver of Liability detailed below.

By clicking yes to our terms of service and waiver of liability agreement, you (booking leader) and your accompanying tour group members agree to assume all legal liabilities as indicated and acknowledge full legal consent that you and all of your accompanying tour participants fully agree to the terms of service and waiver of liability agreement detailed below and will adhere responsibly.

Best of Houston Driving Van Tours and Private Tours:

​

  1. Please make every effort to meet your Tour Group Leader at the specified Tour Starting Time/Starting Point in a timely manner as we will only wait a maximum of 5 minutes after the scheduled our start time. 

  2. Failure to arrive to your tour on time including more than 5 minutes after the scheduled Tour start time will result in a postponed tour subject to tour availability or an abandoned tour if we do not hear from you on or before the tour date.  

  3. Children below the age of 6 are welcome to join tour but require their own valid entry ticket and safety child car seat provided by the accompanied parent. Babies are not permitted due to Texas traffic laws

  4. You and your accompanying tour group members agree to this release of all claims, waiver of liability and assumption of risk (“Waiver and Release”).  and your accompanying tour group members waive any and all claims they may have now and in the future against Astroville Tours LLC, and release from all liability and agree not to sue Astroville Tours LLC, its officers, agents, representatives, employees or tour guides for any personal injury, death, property damage, or loss sustained as a result of their participation in the Astroville Best of Houston Driving Tour or Private tour due to any cause whatsoever, including without limitation, negligence on the part of Astroville Tours LLC, its staff, tour partners, or other participants. You and your accompanying tour group members further agree that if a person violates this agreement and attempts to bring suit against any part of parties named herein, that he/she will be held individually responsible for attorney’s fees and any costs incurred by that person in defending such action.

  5. You and your accompanying tour group members are aware that the tour, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which include weather extremes and traffic conditions subject to sudden and unexpected change. You and your accompanying tour group members accept all the inherent risks of the proposed Astroville Best of Houston Driving Tour or Private Tour and the possibility of personal injury, death or property damage or loss resulting there from. You and your accompanying tour group members acknowledge that the enjoyment and excitement of the proposed form of tour is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for participation. 

  6. Please do not swear or make obscene gestures. Use of abusive language is prohibited during all Tours and may result in an abandoned tour and possible ban per discretion.  Please dress in appropriate attire. No Bathing Suits, Miniature Tank-Tops, Pajamas,  Bikinis, or Clothing with inappropriate language / images. 

  7. Please remain within close proximity of the Tour Group Leader and your Tour Group at all times. Failure to remain with the Tour Group will cause tour delays and disrupt the experience for everyone. If you and your tour participants do not stay with your group, this may result in an abandoned tour and possible ban per discretion. 

  8. If you or any of your party members need to utilize the Restroom or begin to feel ill, please alert your Tour Group Leader immediately.  

  9. Astroville Tours LLC is not legally liable for any personal damage, illness, or health problem experienced during any Astroville company tours. Please exercise wise discretion and responsible decision making with respect to behavior and drinking/eating responsibly during the full duration of the tour.

  10. Astroville Tours LLC is not legally liable for any costs including medical, insurance, health, transportation fees incurred with any type of medical condition contracted during Astroville company tours.

  11. Astroville Tours LLC is not legally liable for any civil/federal offenses that may or may have not occurred during any Astroville company tours. This includes destruction of property, traffic law violations, and all disorderly persons/federal offenses, and operating a vehicle under the influence (DUI/DWI).

  12. Astroville Tours LLC may take photos of tour clients during Astroville company tours and save your contact information including email and phone number for promotional purposes. 

  13. Any unauthorized videotaping, filming, recording, or any other type of audio/visual taping of live Astroville tours is considered violation of copyright law and is strictly prohibited at all times unless otherwise approved by the tour guide in advance of the tour.

  14. Any unauthorized videotaping, filming, recording, or any other type of audio/visual taping of Astroville tours will result in an immediate termination of the tour and lifetime ban from all Astroville tour experiences (No refund). Astroville Tours LLC also has the right to take any necessary legal action against the party responsible for the unauthorized of videotaping, video filming, or video/audio recording subject to state and national copyright laws. 

  15. For authorization of videotaping, filming, recording, or any other type of audio/visual taping of live Astroville tours, please give us a call before at 713-469-2365 for proper security clearance with the Event Manager on staff. We recommend to do this at least within 24 hours of the Tour start time to guarantee a response from our Event Manager.

Tunnel Tour/Food Tours and Private Tours:

​

  1. Please make every effort to meet your Tour Group Leader at the specified Tour Starting Time/Starting Point in a timely manner as we will only wait a maximum of 5 minutes after the scheduled our start time. 

  2. Failure to arrive to your tour on time including more than 5 minutes after the scheduled Tour start time will result in a postponed tour subject to tour availability or an abandoned tour if we do not hear from you on or before the tour date.  

  3. Children & toddlers are welcome to join tour and do require their own valid entry ticket. Babies are not permitted due to private property regulations set by Houston skyscraper building management.  

  4. You and your accompanying tour group members agree to this release of all claims, waiver of liability and assumption of risk (“Waiver and Release”). You and your accompanying tour group members waive any and all claims they may have now and in the future against Astroville Tours LLC, and release from all liability and agree not to sue Astroville Tours LLC, its officers, agents, representatives, employees or tour guides for any personal injury, death, property damage, or loss sustained as a result of their participation in the Astroville Underground Tunnel tour, Astroville Food Tour of Downtown Houston or Private tour due to any cause whatsoever, including without limitation, negligence on the part of Astroville Tours LLC, its staff, tour partners, or other participants. You and your accompanying tour group members further agree that if a person violates this agreement and attempts to bring suit against any part of parties named herein, that he/she will be held individually responsible for attorney’s fees and any costs incurred by that person in defending such action.

  5. You and your accompanying tour group members acknowledge that the enjoyment and excitement of the proposed form of tour is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for participation. 

  6. If you or any of your accompanying tour participants have any type of Food Allergy(s) or Medical Condition(s), it is the tour booking leader's legal obligation to disclose this specific information directly to Astroville Tours LLC within 24 hours of the Tour start time, so we may properly communicate regarding Food Allergy(s) or Medical Condition(s) with restaurant partners accordingly. We also advise that you share details of your Food Allergies or Medical Conditions with the tour guide before the tour as a precautionary measure. At the discretion of the tour guide, there is a $10 fee per person for all Food tour plate modifications as a result of allergies/diet restrictions.

COVID-19 Liability

As we have always been sincerely respectful of personal hygiene especially more so than ever during the ongoing COVID-19 pandemic, please note that all Astroville Tours LLC company tours are regulated as follows:

1. Face masks provided for tour group per request. 

2. Hand sanitizer available to tour group and our employees.

3. Social distancing enforced throughout tours. 

4. Employees required to regularly wash hands.

5. Regular temperature checks for employees.

6. Contactless mobile transfer of tour photos via email/text.

7. Contactless payments for gratuities and add-ons.

**Astroville Tours LLC is not legally liable for any medical, insurance, health, or transportation costs fees related to exposure to COVID-19.  By agreeing to the Terms and Service Agreement before payment of tour charges, each tour booking leader & fellow participant(s) acknowledge that there is an inherent risk of exposure to COVID-19 exists in any public place where people are present. By agreeing to the Terms of Service Agreement upon payment of tour charges, each tour booking leader & fellow participant(s) voluntarily assume all risks related to the exposure to COVID-19 and agree not to hold Astroville Tours LLC or any of its active employees legally liable. **

 

                                              Cancellation/Refund Policy:

1. All types of remittances including invoice payments made online to Astroville Tours LLC are non-refundable unless of a tour cancellation caused by an extreme Natural Disasters, Severe Inclement Weather, Political Instability/Rallies, or another genuine extenuating circumstance including national/regional pandemics and other types of contagious bacterial infection(s)/disease(s). 

2. If any of the circumstances listed above are applicable on or near your tour date, full refunds will be processed within 2-3 business days. 

3. Re-scheduling requests can be made by calling us directly at 713-469-2365 or by sending us an email at astrovilletours@gmail.com at least 24 hours in advance of the tour start time. It is important to note that you will need the First/Last name on the booking reservation (our website) or the Booking Reference number from our alternative vendors including TripAdivsor, Viator, Visit Houston, Booking, Expedia, Klook, Civatatis, GetYourGuide.

4. Customers can always utilize their booking confirmation information received in the initial booking reservation email to reschedule for a future date free of charge as long as this Re-Scheduling Request is completed within 24 hours of the tour start time. 

5. One (1) Re-scheduling Request is permitted per party free of charge. All additional Re-Scheduling Requests including 2nd and 3rd requests will be processed with a $50 fee per tour party. 

6. We will not accept any Re-scheduling Requests made less than 24 hours in advance of the original Tour start time. If you need to re-schedule your Tour date, please make sure to contact us more than 24 hours in advance of your tour start time or your re-scheduling request may not be honored. 

7.  If we do not hear back from you by the original tour start time, we will proceed to deem your Tour as “abandoned,” and you will need to book a new tour date online at full cost. 

8. The Astroville Best of Houston Driving Tour requires a minimum number of four (4) tour guests on normal weeks and six (6) tour guests on holiday weeks. The Astroville Food Tour of Downtown Houston requires a minimum number of five (5) tour guests on normal weeks and ten (10) tour guests on holiday weeks. If the tour is canceled because the minimum isn’t met, you’ll be offered a different date/full refund.

Electronic Communications

By visiting Astrovilletours.com or sending any type of emails to Astroville Tours constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing. Certain services made available via astrovilletours.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the Astrovilletours.com domain, you hereby acknowledge and consent that Astroville Tours may share such information and data with any third party with whom Astroville Tours has a contractual relationship to provide the requested product, service or functionality on behalf of Astrovilletours.com users and customers.

You may not use the Astroville Tours Website in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site. You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Astroville Tours LLC’s content is not for resale. Third Party Accounts

You will be able to connect your Astroville Tour LLC account to third party accounts. By connecting your Astroville Tours account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.

International Users

The Service is controlled, operated and administered by Astroville Tours LLC from our offices within the United States of America. If you access the Service from a location outside the United States of America, you are responsible for compliance with all local laws. You agree that you will not use Astroville Tours LLC’s Content accessed through astrovilletours.com or any of company digital’s accounts in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Astroville Tours LLC, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Astroville Tours LLC reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Astroville Tours LLC  in asserting any available defenses.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Astroville Tours LLC agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. ASTROVILLE TOURS LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME. ASTROVILLE TOURS LLC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. ASTROVILLE TOURS LLC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. 

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ASTROVILLE TOURS LLC AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF ASTROVILLE TOURS LLC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. Termination/Access Restriction

Unless otherwise specified herein, this agreement constitutes the entire agreement between the User and Astroville Tours LLC with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Astroville Tours LLC with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
